Risk disclosure
General Risk Disclosure
This statement provides you with information about the risks associated with the services offered by Upside.Trading.
Upside.Trading is a Dutch cooperative with the goal of developing and facilitating a trading platform and offering automated trading strategies. Upside.Trading offers users the ability to automatically manage and administer their cryptocurrency accounts held with a registered exchange.
This statement provides information on the risks associated with these products, but it does not explain all risks, nor how these risks may apply to your personal circumstances. If you have doubts, you should seek professional advice. It is important that you fully understand the risks before you decide to trade via Upside.Trading, that you have sufficient financial means to bear such risks, and that you carefully monitor your positions. Investing carries a risk to your capital. You should not invest money that you cannot afford to lose. You cannot lose more than the capital in your account with the exchange.
Position Monitoring
You must ensure that you can monitor the positions in your account at all times, as you are solely responsible for this. We are not responsible for monitoring the positions in your account.
Execution
There are risks associated with executing agreements online via trading systems, including but not limited to software and hardware failures and internet disruptions.
Cryptocurrency
THE MARKETS FOR CRYPTOCURRENCY ARE SOLELY DETERMINED BY SUPPLY AND DEMAND. The cryptocurrency market is dynamic, and the involved prices are often highly unpredictable and extremely volatile. Cryptocurrency prices are typically non-transparent, highly speculative, and subject to market manipulation. In the worst case, the product may even become worthless.
It is important to distinguish between indicative prices shown in charts and actual trading prices displayed on our platform. Indicative prices merely provide an estimate of market levels. Since cryptocurrency markets are decentralized—meaning there is no single central exchange where all transactions occur—each market maker may quote slightly different prices. Consequently, prices displayed in a chart by us or a third party are merely "indicative prices" and not necessarily the actual "trading prices" for executing investments.
Investments in cryptocurrency are susceptible to abuse for illegal activities due to transaction anonymity, and investors may be adversely affected if law enforcement authorities investigate potentially unauthorized activities.
Cryptocurrency should be viewed as a high-risk asset. You should never invest funds that you cannot afford to lose.
Given the above, cryptocurrencies are not suitable for all investors. You should not invest in these products unless you possess the necessary knowledge and expertise, understand the characteristics of these products and your exposure to risk, and are convinced of their suitability based on your circumstances and financial position. Moreover, using our services should never be considered a safe investment but rather as an investment with an inherent risk of loss. Your own exchange must always remind you of this.
The risk of loss when investing in cryptocurrency can be substantial. Therefore, considering your circumstances and financial means, you should carefully determine whether such investments are appropriate for you. You should be aware that you could lose all the funds in your account with the exchange.
Under certain market conditions, it may be difficult or impossible to liquidate a position. This could occur, for example, if market liquidity is insufficient or if the market reaches a daily price fluctuation limit ('limit move').
Automated Trading and Internet Risks
When trading via our website and/or applications, system failures may occur. You should be aware of the risks that may result from a system failure, which could mean that your order is delayed or fails.
You acknowledge that there are risks associated with using an internet-based trading system, including but not limited to hardware, software, and internet connection failures, the risk of malicious software, and the risk that third parties may gain unauthorized access to your information and/or assets. Computer viruses, communication failures, disruptions, errors, distortions, or delays that you may experience when trading via our services—regardless of their cause—spyware, scareware, Trojan horses, worms, or other malware that could affect your computer or other equipment, or "phishing," "spoofing," or other attacks. You should also be aware that SMS and email services are vulnerable to "spoofing" and "phishing" attacks and exercise caution when evaluating messages that appear to originate from Upside.Trading.
